I understand you heard this first hand and I believe that... about the tips, though and her keeping 5% + keeping any given by debit... I can't help but think if it were myself interviewing for the job, I'd ask how tips are handled... and if someone took the job knowing she keeps 5% + any given by debit, well.... they took the job so to complain afterwards is pointless.
If it came up afterwards, that's sneaky... totally sneaky and I can understand being upset over that!

Tee..I did work for her for two weeks...when I started, she asked for 5% of the tips. That is fine with me..however..I caught her pocketing tips from the debit. And yes I asked her about that...she just went ditzy on me.
She is very hard on her staff, that is the reason why she can't keep staff in her business. I only agreed to work for her to help her as she was without enough staff, she complained constantly that she couldn't find good people to work for her. She has had quite a large number of 'good' people come in to work...it's her actions that drive them off.

I certainly hope she pays all of her taxes on those tips.....

I doubt it... I doubt most do though... and more than those waiting on tables.. thinking of various 'tips' I have given... hairdressers, cab drivers, etc...
Not sure of the 'tax laws' about it but I seem to recall it's a %? Not sure.

yes, it's a percentage of your wages...I'm still not sure of that 'law' as a tip is a gift, not a wage...

I think the argument was that it was payment for services rendered and therefore income. (not saying I agree, just trying to remember the justification from when the law came in)

I can't quite recall the exact wording either on claiming tips...although...to the rational person, when I pay for the meal, I am also paying for the delivery of that meal..the tip should be classifed as a gift, but...government is government and they will exact that last drop of blood... ;)

The Income Tax Act itself requires inclusion of all amounts, including gratuities, received as a result of office or employment. (This extends to more than just gratuities.)

So, its not the nature of the payment, but the nature of the receipt.
